CrossFit Castaway Box II - Terms & Conditions

 

Here at CrossFit Castaway Box II, our aim is to be as flexible as possible to the benefit of our members, although we do ask that you help us to provide you with the best facility and service we can by noting and adhering to our terms and conditions.

 

Please be sure to read the following membership terms and conditions below and contact us if there is anything you are unclear of.

 

Monthly Membership

 

Recurring Billing Cycle:  CrossFit monthly memberships are based on a 30-day recurring billing cycle.  Your first payment will occur once registration has been submitted and recurring charges will be processed every 30 days until membership cancellation is requested.

 

Cancellation Policy: Memberships may be cancelled by giving 2 months written notice to cancel/terminate. Membership fees will continue to be charged until the notice period has expired. Late notices will result in continued billing until cancellation terms are met.

 

Notices must be sent in writing to the Box email address info@crossfit-guernsey.gg. No other method of notice shall be considered valid and memberships will continue to run until a valid notice has been received.

 

Default Billing: All members are required to keep an active credit card or bank account on file to be used for membership dues or default billing. Please note that monthly membership payments must be processed via Braintree, our online payment partner.

 

*No cash receipts or card payments will be accepted for payment of monthly membership fees.

 

Cancellation Charge: Early cancellation of memberships will be charged in accordance with the terms details in ‘Cancellation Policy’ above. Members will still be entitled to attend the gym as normal during the notice period.

 

No Refunds: Once registration has been submitted or payment has been received there are no refunds under any circumstances. This is without exception.

 

3, 6 and 12 Month Memberships (Up-front one-off payments)

Pre-paid memberships:  CrossFit Castaway offer members the option to purchase discounted longer-term memberships by making a one-off up-front payment. Extended-term memberships include 3, 6 and 12 months.

 

Cancellation Policy: Pre-paid memberships may not be cancelled during the duration of a current membership as we operate a no-refund policy.

 

Memberships may be cancelled in advance of the commencement of a new membership cycle by giving 2 months written notice to cancel/terminate (e.g. if a member holds a 6-month membership that has commenced on 1 January, notice should be given prior to 30th April to avoid membership renewal. If late notice is given, then membership fees will continue to be charged until the notice period of 2 months has expired. Late notices will result in continued billing until cancellation terms are met.

Cancellation Charge: For pre-paid memberships a three-month cancellation period will apply upon giving the required written notice. Members will be charged at the discounted rate for each month depending on the type of membership.  (For example, should you cancel your pre-paid 12-month CF Unlimited membership early, a further two months fees will be taken at the equivalent rate per month, so for an annual unlimited membership at £1,200 per annum, a cancellation charge of £200 will be payable in advance).

 

Members will still be entitled to attend the gym as normal during the notice period.

 

To avoid cancellation charges for pre-paid memberships, notice should be given 2 months prior to the expiration of memberships.

 

Automatic Renewal:  Once annual membership term has expired you will be automatically renewed under the initial terms of your membership for a consecutive term until membership cancellation is requested.

 

No Refunds: Once registration has been submitted or payment has been received there are no refunds under any circumstances. This is without exception.

 

Membership Holds

 

Memberships may be put on hold for a minimum of 1 week and maximum of two weeks upon giving written request to the Box email address info@crossfit-guernsey.gg. Requests should detail the period for which the pause is requested, to include a pause start date and end date.

 

Members will not be charged for pauses, although we ask that pause requests only be made for circumstances such as annual holidays, not for short term circumstances such as low-level illness i.e. colds.

 

Should a member suffer an injury or serious illness then an extended membership pause may be applied. Evidence in support of the extended pause request is required in order to place your membership on hold. Notification of the extended pause request should give via the Box email address.

Membership Cancellations

Management reserve the right to cancel or terminate the membership of any member of the gym with immediate effect if the members conduct is deemed inappropriate, offensive, dangerous or potentially injurious to the interests and reputation of the gym. Management is not obliged to disclose reasons for decisions made.

 

Any members whose membership has been terminated forfeits any right to claim against the gym or it’s owners and shall not be entitled to refund for any unused period of their membership.

 

Complaints

Should any member have a complaint concerning the gym, the behaviour of a member of it’s staff or members, then a written form of complaint should be sent via email to info@crossfit-guernsey.gg

 

Any complaints received shall be considered by management and any appropriate action shall be taken, if considered appropriate.

General Health & Safety

Members safety is paramount, and to protect the safety of members we ask that guests pay attention to all signs and notices relating to health and safety.

 

  • If you hear the fire alarm members should exit the building as quickly as possible in an orderly manner, leaving all belongings behind. The fire assembly point is by the coded gate leading to the Waitrose parking area.

  • Should you suffer an injury then you must immediately advise one of our coaches.

  • Please refrain from using the gym should you be suffering from an infectious illness.

Car Park

The gym rents parking spaces from Waitrose for the convenience of its members. Members use the car park at their own risk and the gym holds no responsibility for any loss or damage from or to any vehicle therein parked.

 

Members are obliged to obtain and display a CrossFit parking permit from the gym. The gym shall not be responsible for any parking fines received by any member because of failing to obtain and/or display a parking permit.

Photographs & Videos

On occasions the coaches will take photographs and videos of classes for the purposes of posting on the gym members page and/or promotional purposes on social media. Unless otherwise informed, members implied permission is taken for the gym to use any photographic or video material for such purposes.

 

Discounts

 

10% Discount is available to:

  • Students with a valid Students/NUS Identity Card (card must be presented upon registration to qualify)

  • Corporate discount for companies with a formal arrangement with CrossFit Castaway Box II where more than 5 employees are registered as active members.

 

15% Discount is available to:

  • Emergency Services Personnel (Fire, Ambulance, Police) and States nursing staff. Valid evidence must be presented at the time of registration. (This discount does not extend to general States workers such as teachers or administration staff).

  • Qualifying Sports teams players/staff. Valid evidence must be presented at the time of registration. See management for details on qualification.

Discounts do not apply to Off-Peak or Open gym memberships.

 

General Class Policies:

 

Missed Classes/Make-ups: All missed classes due to vacation, illness or leave of absence must be made-up during your current billing cycle and may not be carried over to future cycles. A medical note is required to suspend membership in the event of illness, injury or medical leave of absence (see Membership Hold).

 

Upgrades/Downgrades: Membership changes must be made in writing to the Box email address to upgrade or downgrade membership to another plan.

 

Late Payments: Late membership dues beyond 3-day grace period will result in memberships being blocked to prevent class bookings until fees are paid.

 

Subject to Change: CrossFit Castaway Box II reserves the right to make any and all changes to the terms and conditions. CrossFit Castaway Box II is not responsible for any errors that may appear on its website. CrossFit Castaway Box II reserve the right to make any and all changes class times, schedules and locations without any notice.

While attending CrossFit Castaway Box II classes you also agree to the following terms:

  • The coach/trainer will use their skills and knowledge to design a safe programme of exercise that will consider the personal goals, fitness levels and exercise likes and dislikes.

  • The coach/trainer will provide the coaching, supervision advice and support that the client may need to help them achieve their goals. The client’s progress will be regularly monitored, and the programme revised and adjusted accordingly.

  • The coach/trainer will provide all necessary equipment and will organise appropriate venues for all training sessions.

  • All client information will be kept strictly private and confidential. If the coach/trainer requires further medical information from a practitioner, the client must provide such details.

  • It is understood between client and coach/trainer that both will commit to the sessions and give 100% effort.

  • You are required to arrive at least 5 minutes prior to a training session so that a full session can be achieved on each visit.

  • Sessions will take place in all weather conditions unless notified.

  • You are required to wear appropriate clothing and footwear. Clothes should be loose fitting and non-restrictive. Footwear should be comfortable and provide adequate support.

  • Occasional videos/photos may be taken for social media and marketing purposes only.

 

Health Screening

  • All clients must complete a Waiver before commencing any exercise programme.

  • Your coach may require a letter of ‘medical clearance’ from your GP. Please be aware that your GP may charge you for this.

  • Participation in any exercise may involve the risk of injury and possibly the risk of death. You exercise at your own risk; your health and safety are your own responsibility and you should never exercise beyond your ability. Members should not use equipment or partake in an activity or class unless you have briefed and confident in the use of the equipment and are satisfied you are able to operate this safely and effectively to minimise the risk of injury.

  • The equipment within the Box is regularly checked, although if you notice any problems with the equipment please notify a member of the coaching staff.

  • At certain times the gym may not be supervised. At these times members are advised to use the facilities at their own risk. Every effort is made to ensure the safety of members, the management cannot accept any responsibility for any accident or injury that may occur.

  • The minimum age for a potential member to register with the gym is 18 years.

Liability

  • We do not accept liability for the injury or death of any members, dependant or guest that may happen in the gym or the vicinity of the gym.

  • We do not accept liability for any damage or loss to any property of a member, dependant or guest that happens on the premises or in the vicinity of the gym.

Lateness Policy

  • If you are late for a session the session will not be extended and will end at the appointed time.

  • If the trainer is late, additional time will be added to the session or to subsequent sessions.

 

GDPR

  • We adhere to the General Data Protection Regulation

  • We will deal with all information we hold about you in line with our privacy notice, which you will find on our website. If you would like to know about the information, we hold about you, or if you’d like to update or correct any information please let us know.
